These Website Terms of Use apply to your access to and use of the website located at https://notly.ai and any related webpages, landing pages, demo request forms, contact forms, help pages, product information pages, and website content operated by or on behalf of [isim.ai Pty Ltd] (“Notly.ai”, “Notly”, “we”, “our”, or “us”).
By accessing or using the Website, you agree to be bound by these Website Terms of Use and our Privacy Policy. If you do not agree, you must not access or use the Website.
If you use the Website on behalf of a clinic, practice, healthcare organisation, company, partnership, trust, government body, or other entity, you represent that you have authority to bind that organisation. In that case, “you” and “your” include both you personally and the organisation you represent.
Separate platform terms may apply. Use of the Notly.ai application, ambient documentation platform, AI scribe service, clinician dashboard, templates, integrations, subscriptions, beta tools, or any paid or trial services may be governed by separate Platform Terms, subscription terms, data processing terms, privacy terms, or a signed service agreement.

About Notly.ai
Notly.ai provides information about an ambient AI clinical documentation platform designed to assist clinicians and healthcare teams with clinical notes, referral letters, discharge summaries, coding prompts, documentation workflows, and related administrative drafting tasks.
Notly.ai is intended to support clinician-controlled documentation workflows. It is not a replacement for clinical judgement, professional responsibility, patient assessment, clinical decision-making, or medico-legal review.
03 · No medical advice
The Website does not provide medical advice
The Website and its content are provided for general information, product education, and demonstration purposes only.
Notly.ai does not provide medical advice, medical diagnosis, medical treatment, prescribing advice, emergency advice, or patient-specific clinical recommendations through the Website.
Nothing on the Website should be treated as a substitute for advice from a qualified healthcare professional. Patients should always seek advice from their treating doctor or other qualified healthcare provider about any medical condition, symptom, investigation, diagnosis, treatment, or medication.
If you believe there is a medical emergency, contact emergency services immediately. Accessing or using the Website does not create a doctor-patient relationship, provider-patient relationship, therapist-patient relationship, or other clinical relationship between you and Notly.ai.
04 · Clinician responsibility
AI-generated documentation must be reviewed
Notly.ai may describe features that assist with transcription, summarisation, drafting, structuring, coding prompts, referral letters, discharge summaries, and clinical documentation workflows.
Any AI-generated output must be reviewed, edited, verified, and approved by an appropriately qualified clinician or authorised healthcare professional before it is used, copied into a medical record, sent to another provider, used for billing, used for coding, relied on for clinical care, or shared with a patient or third party.
You are responsible for ensuring that any documentation created, edited, exported, or used through Notly.ai is accurate, complete, clinically appropriate, compliant with professional standards, and suitable for your intended use.
Notly.ai does not independently verify patient identity, clinical facts, examination findings, investigation results, medication lists, allergies, diagnoses, coding decisions, billing decisions, or clinical plans. You must not use Notly.ai as an autonomous medical decision-making system.
05 · Privacy and patient data
Patient consent, recordings, and personal information
If you use any Notly.ai service to record, transcribe, summarise, process, upload, store, or generate content from a patient consultation, you are responsible for obtaining all consents, notices, permissions, and authorisations required by law, professional standards, workplace policy, and patient expectations.
You must not submit, upload, transmit, or disclose patient information, health information, personal information, audio recordings, transcripts, images, documents, or other confidential information unless you have the right to do so.
You should not submit patient health information through public Website contact forms, demo forms, chat widgets, or general email addresses unless Notly.ai has expressly provided a secure and appropriate method for that purpose.
Your use of the Website may involve the collection and handling of personal information, such as your name, email address, phone number, clinic name, role, organisation, message content, demo request details, technical information, usage data, cookies, and analytics information. Our handling of personal information is described in our Privacy Policy.
Healthcare data caution: Use of clinical data within the Notly.ai platform may be governed by separate privacy, security, data processing, and platform terms.
06 · Acceptable use
Use the Website lawfully and responsibly
You must use the Website lawfully, responsibly, and in accordance with these Terms.
You must not:
- Use the Website for any unlawful, fraudulent, misleading, harmful, or unauthorised purpose;
- Use the Website to provide, request, or rely on emergency medical advice;
- Upload or transmit patient information through public Website forms unless expressly authorised;
- Impersonate another person or organisation, or misrepresent your identity, role, credentials, employer, authority, or affiliation;
- Interfere with or disrupt the Website, servers, networks, security controls, or technical systems;
- Attempt to gain unauthorised access to accounts, systems, data, files, passwords, source code, infrastructure, or non-public areas;
- Introduce viruses, malware, spyware, ransomware, worms, logic bombs, harmful code, or similar material;
- Use bots, crawlers, scrapers, data mining tools, automated extraction tools, or other automated methods to access, monitor, copy, harvest, or index the Website except as permitted by our robots.txt file or by written agreement;
- Use the Website or its content to train, fine-tune, benchmark, develop, or improve a competing AI, machine learning, clinical documentation, transcription, medical scribe, or automation product without written permission;
- Copy the Website design, product messaging, templates, interface, workflows, or product previews for a competing business.

Ownership of Website content and branding
The Website and all content on it, including text, graphics, logos, icons, product names, layouts, designs, software, code, images, illustrations, videos, animations, documents, templates, workflows, product descriptions, interface previews, demonstrations, and other materials, are owned by or licensed to Notly.ai.
The Website content is protected by copyright, trade mark, design, confidentiality, database, and other intellectual property laws. You may access and use the Website for your own internal, informational, and evaluation purposes only.
You must not copy, reproduce, modify, adapt, translate, publish, distribute, sell, license, reverse engineer, scrape, frame, mirror, commercially exploit, or create derivative works from the Website or its content unless we have given written permission or the law allows it.
“Notly.ai”, “Notly”, the Notly.ai logo, product names, design marks, slogans, and related branding are trade marks or trade indicia of Notly.ai or its related entities. 08 · Feedback
Suggestions and product feedback
We welcome feedback, comments, ideas, suggestions, feature requests, workflow suggestions, template suggestions, bug reports, and improvement ideas.
You agree that any feedback you provide may be used by Notly.ai without restriction, payment, attribution, or obligation to you. Feedback does not create any ownership right for you in Notly.ai products, services, features, documentation, templates, workflows, or improvements.
You must not send confidential, proprietary, patient, or third-party information as feedback unless you are authorised to do so and the method of submission is appropriate.

10 · Website changes
Availability, updates, and product information
We may modify, suspend, restrict, withdraw, replace, or discontinue any part of the Website at any time. We do not guarantee that the Website will always be available, uninterrupted, secure, error-free, or free from defects, viruses, or harmful components.
The Website may describe current, planned, beta, experimental, or future Notly.ai features. Product information, screenshots, examples, demo outputs, interface previews, templates, workflow descriptions, and marketing statements are provided for general information only and may not represent the final or current version of the product.
Unless expressly agreed in a signed written contract, Website statements do not create a binding commitment to deliver a particular feature, integration, workflow, compliance status, security configuration, pricing plan, uptime level, or release date.
11 · Cancellation Policy
Cancellation Policy
You may cancel your Notly subscription at any time through your account settings or by contacting our support team.
When you cancel, your subscription will remain active until the end of your current billing period. After that date, your subscription will not renew, and access to paid features may be downgraded or removed.
For monthly subscriptions, cancellation stops the next monthly renewal. For annual subscriptions, cancellation stops the next annual renewal, but access continues until the end of the current annual subscription period.
Notly does not generally provide refunds or credits for unused portions of a subscription period, unless required by law or agreed by Notly in writing.
If Notly withdraws a paid service or materially changes the service in a way that prevents you from using the subscription, Notly may provide a pro-rata refund or account credit at its discretion, subject to applicable law.
12 · Liability
No warranties, limitation of liability, and indemnity
To the maximum extent permitted by law, the Website and Website content are provided on an “as is” and “as available” basis. We do not represent or warrant that the Website or Website content will be accurate, complete, current, uninterrupted, secure, error-free, fit for a particular purpose, suitable for clinical use, suitable for regulatory compliance, or free from harmful components.
To the maximum extent permitted by law, Notly.ai and its officers, directors, employees, contractors, advisers, licensors, suppliers, affiliates, and representatives are not liable for any indirect, incidental, special, consequential, exemplary, punitive, or economic loss, including loss of profit, loss of revenue, loss of goodwill, loss of opportunity, loss of data, loss of business, clinical workflow disruption, system downtime, or reputational damage.
To the maximum extent permitted by law, our total liability arising out of or in connection with the Website or these Website Terms is limited to AUD $100. Where liability cannot be excluded but can be limited, our liability is limited, at our option, to resupplying the relevant service or paying the cost of having the service supplied again.
You agree to indemnify Notly.ai from claims, losses, liabilities, damages, penalties, costs, and expenses arising from your breach of these Terms, misuse of the Website, unauthorised use of Website content, breach of privacy or confidentiality obligations, submission of information that you were not authorised to provide, violation of law, or use of Notly.ai output without appropriate clinician review.
Non-excludable rights: Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, remedy, or protection that cannot lawfully be excluded, restricted, or modified under applicable law.
13 · Law and disputes
Governing law and dispute resolution
Before starting court proceedings, either party should first try to resolve any dispute in good faith by written notice and reasonable negotiation. This does not prevent either party from seeking urgent injunctive, equitable, or protective relief where necessary.
These Website Terms are governed by the laws of Queensland, Australia, unless a different governing law is required by a signed written agreement between you and Notly.ai. The parties submit to the non-exclusive jurisdiction of the courts of Queensland and the courts competent to hear appeals from those courts.
